Agreement to these terms
These Terms of Service (“Terms”) govern your use of mdmerit.com and the services offered by MD Merit, operated by [MD Merit, LLC]. By using this site or submitting an inquiry, you agree to these Terms. If you do not agree, please do not use the site.
What MD Merit is – and is not
MD Merit provides physician review of medical records and a written merit assessment only. A merit assessment is a professional opinion about whether the care in question appears to have fallen below the standard of care.

- MD Merit does not provide medical treatment or care.
- No physician–patient relationship and no attorney–client relationship is created by a merit review or by submitting an inquiry.
No guarantee of outcome
A merit assessment is a professional opinion and is not a guarantee of any legal outcome. MD Merit does not predict how any claim will be resolved. Our materials describe the review process and the realities of expert support, not the likely result of a case.
Submitting an inquiry
Submitting the case-submission form is free and does not obligate you to purchase a review. It does not create any professional relationship. Nothing begins until you approve the fee and sign the review agreement.
Fees
Merit reviews are offered for a flat fee, quoted to you before any work begins. Payment is due after you confirm the fee and before the review starts. The specific terms, including any refund terms, are set out in the intake and review agreement. [Fee and refund terms to be finalized with counsel.]
Records you provide
You are responsible for the accuracy and completeness of the information and records you provide. Do not send medical records by email; we will provide secure instructions when records are needed. The quality of a merit assessment depends on the completeness of the records reviewed.
Referrals and your choice
If a case appears to have merit, MD Merit may, with your agreement, refer it to an independent law firm. You are always free to decline a referral and take the merit assessment to any attorney you choose. MD Merit does not receive any referral fee or share of any legal recovery; the terms of any referral are disclosed in the intake agreement. The Reviewing Physician

Acceptable use
You agree to provide truthful information and to use this site and service only for lawful purposes related to your own inquiry or one you are authorized to make on another person’s behalf.
Intellectual property
The content, design, and materials on this site are owned by MD Merit or its licensors and may not be copied or reused without permission, except that a merit assessment prepared for you is yours to use as described in your agreement.
Disclaimers and limitation of liability
This site and its general content are provided “as is” for informational purposes and are not a substitute for legal or medical advice. To the fullest extent permitted by law, MD Merit is not liable for indirect or consequential damages arising from use of the site. [Limitation-of-liability terms to be finalized with counsel.]
Governing law
